Originally published as an op-ed in the<\/span><a href=\"https:\/\/ecre.org\/op-ed-one-question-on-the-deadly-greek-coast-guard-operation-in-chios\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> ECRE Weekly Bulletin<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2450036 elementor-widget elementor-widget-text-editor\" data-id=\"2450036\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Painful questions have gripped Greece since the night of 3 February, when 15 people lost their lives and another 24 suffered severe injuries after a Greek Coast Guard vessel <\/span><a href=\"https:\/\/rsaegean.org\/en\/chios-greece-deadly-tragedy-following-collision-between-coast-guard-vessel-and-boat-carrying-refugees\/\"><span style=\"font-weight: 400;\">collided<\/span><\/a><span style=\"font-weight: 400;\"> with a boat carrying refugees off the coast of the island of Chios. The simplest is the most pressing: What do we do now?<\/span><\/p><p><b>One<\/b><span style=\"font-weight: 400;\">: Help survivors recover safely and humanely. On Chios, some remain hospitalised in critical condition and others have already been referred to registration.\u00a0 Several were transferred to Athens unregistered, undocumented and vulnerable to arbitrary arrest or even prison under <\/span><a href=\"https:\/\/rsaegean.org\/el\/nomoschedio-epistrofon-comments\/\"><span style=\"font-weight: 400;\">recent criminal laws<\/span><\/a><span style=\"font-weight: 400;\"> punishing \u201cillegal stay\u201d. People recovering in hospitals have been denied visits and access even to their lawyers, who were asked to provide written authorisations to meet their clients.<\/span><\/p><p><b>Two<\/b><span style=\"font-weight: 400;\">: Treat victims and their loved ones with dignity and respect. Ensure relatives are informed of developments that concern them in ongoing identification procedures.<\/span><\/p><p><b>Three<\/b><span style=\"font-weight: 400;\">: Safeguard and deliver justice. The incident must be investigated by prosecution services independent from the involved parties. Evidence must be promptly protected and thoroughly assessed, from testimonies of survivors to inspection of vessels and audiovisual footage from recording devices.<\/span><\/p><p><b>Four<\/b><span style=\"font-weight: 400;\">: Contest the policy that enabled this, at home and beyond. The European Court of Human Rights has condemned Greece four times in the last three years for Coast Guard operations that showed contempt for human lives at sea and for deaths of refugees that were never properly investigated. Breaches of the right to life range from failure to perform search and rescue (<\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-218512\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Safi v. Greece<\/span><\/i><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-245252\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">F.M. v. Greece<\/span><\/i><\/a><span style=\"font-weight: 400;\">) to unlawful shootings of refugees at sea (<\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-230390\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Alkhatib v. Greece<\/span><\/i><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-242418\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Almukhlas &amp; Al-Maliki v. Greece<\/span><\/i><\/a><span style=\"font-weight: 400;\">). Less than three years ago, the <\/span><a href=\"https:\/\/rsaegean.org\/en\/two-years-after-the-pylos-crime-developments-in-the-criminal-proceedings-criminal-prosecution\/\"><span style=\"font-weight: 400;\">Pylos shipwreck<\/span><\/a><span style=\"font-weight: 400;\"> claimed over 600 lives.<\/span><\/p><p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/rsaegean.org\/en\/accountability-adrift-in-greek-waters\/\"><span style=\"font-weight: 400;\">absence of accountability<\/span><\/a><span style=\"font-weight: 400;\"> for deaths at sea is an inextricable product of the State \u2013 and EU \u2013 fixation on preventing refugees from reaching European soil at all costs. For Greece, this takes the form of a \u201csystematic practice of push backs\u201d (<\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-240242\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">A.R.E. v. Greece<\/span><\/i><\/a> <span style=\"font-weight: 400;\">and <\/span><a href=\"https:\/\/hudoc.echr.coe.int\/?i=001-243431\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">G.R.J. v. Greece<\/span><\/i><\/a> <span style=\"font-weight: 400;\">words, not the author\u2019s) and an ever-growing pile of shelved investigations in prosecution services. Not a single case has led to criminal prosecution, let alone conviction of perpetrators. Not a single internal Coast Guard investigation has led to disciplinary proceedings. For the European Commission, it manifests as refusal to take legal action despite an abundance of evidence, and in unwavering confidence that Greek investigations will someday deliver.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72b6057 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"72b6057\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-33fbf27 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"33fbf27\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">RSA is providing free legal assistance and representation to survivors and relatives of victims of the Chios incident.
