class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Urgent action is needed to address the longstanding rule of law concerns in Greece. Independent organisations HIAS Greece, Refugee Support Aegean (RSA), Vouliwatch, Greek Council for Refugees (GCR), Hellenic League for Human Rights (HLHR), Homo Digitalis, Reporters United and Solomon track the systemic failings of Greek institutions in their latest annual report. These flaws are interconnected and have nefarious effects on an array of facets of the rule of law, from justice, law-making and transparency rules to press freedom, civil society and data protection.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1b8429 elementor-widget elementor-widget-heading\" data-id=\"a1b8429\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Justice denied against state wrongdoing<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f52b41 elementor-widget elementor-widget-text-editor\" data-id=\"6f52b41\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">The Greek judiciary still lacks the necessary independence, impartiality and effectiveness to investigate unlawful conduct by state officials. These flaws are consistently illustrated in criminal cases that continue to test the public\u2019s declining trust in the courts:<\/p><ul class=\"ul1\"><li class=\"li1\">The <span class=\"s1\"><b>\u201cGreek Watergate\u201d surveillance scandal<\/b><\/span><b> <\/b>is being adjudicated by the Single-Judge Misdemeanour Court of Athens only for four private individuals charged with misdemeanours, over one year after the Supreme Court Prosecutor ruled out the existence of a joint National Intelligence Service (EYP) and Predator surveillance operation targeting ministers, opposition politicians, journalists, businesspeople, EYP employees and high-ranking military officials. An abundance of <a href=\"https:\/\/insidestory.gr\/article\/ypoklopes-enas-dikastis-kanei-osa-den-ekane-o-areios-pagos\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">evidence<\/span><\/a> emerging during the trial corroborates the existence of a joint EYP-Predator surveillance centre. The hearings have shown critical gaps in investigative measures on the part of the prosecution e.g. failure to summon and question the individuals allegedly operating the Predator spyware or <a href=\"https:\/\/www.reportersunited.gr\/13451\/areios-pagos-ypoklopes-fiasko\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">removing Intellexa servers<\/span><\/a> after the outbreak of the scandal, and <a href=\"https:\/\/www.tanea.gr\/print\/2025\/12\/09\/greece\/pos-ekrypsan-ti-syndesi-creyp-predator\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">undue interference and instructions<\/span><\/a> in the technical report delivered by two experts to the Supreme Court Prosecutor three days before the investigation was shelved as far as state officials were concerned.<\/li><\/ul><p class=\"p4\">For its part, EYP has still not complied with the Council of State judgment that declared as unconstitutional the legislative provision prohibiting the opposition leader from being informed of his surveillance. The case is <a href=\"https:\/\/www.in.gr\/2025\/12\/22\/politics\/edda-kalei-tin-kyvernisi-na-apantisei-gia-tin-parakolouthisi-tou-nikou-androulaki-apo-tin-eyp\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">pending<\/span><\/a> before the European Court of Human Rights (ECtHR).<\/p><p class=\"p4\">Impermissible access of senior government officials to information obtained through surveillance has also emerged in the context of the <span class=\"s1\"><b>OPEKEPE agricultural funds misuse scandal <\/b><\/span>investigated by the European Public Prosecutor\u2019s Office (EPPO). The former Deputy Minister of Digital Governance who resigned after the outbreak of the scandal has <a href=\"https:\/\/www.in.gr\/2025\/12\/12\/politics\/politiki-grammateia\/eksetastiki-den-apokalyptei-onoma-apo-maksimou-pou-iksere-gia-tis-episyndeseis-o-mpoukoros-den-tha-syskotiso-antikeimeno-tis-epitropis\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">confirmed<\/span><\/a> that sources close to the Prime Minister\u2019s Office had informed him of his wiretapping as early as June 2024, one year before EPPO <a href=\"https:\/\/www.eppo.europa.eu\/en\/media\/news\/alleged-misuse-eu-agricultural-funds-eppo-submits-information-to-hellenic-parliament\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">transmitted the case file<\/span><\/a> to Parliament to investigate and prosecute ministerial misconduct. In addition, EPPO investigations into the case have faced undue <a href=\"https:\/\/www.tovima.com\/politics\/european-prosecutor-says-greece-tried-to-influence-her-work\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">government interference<\/span><\/a>.<\/p><ul class=\"ul1\"><li class=\"li1\">The deadly <span class=\"s1\"><b>Tempi train crash<\/b> <\/span>that claimed 57 lives on 28 February 2023 brought the public to historic demonstrations with a demand for justice and accountability, met with extreme, unprovoked police repression. Meanwhile, the case marks another investigation marred by systemic shortcomings and indications of interference with the justice system. Investigative steps were fragmented across multiple proceedings, crucial evidence was handled belatedly or inadequately. Repeated requests for exhumation of victims to conduct examinations and to clarify causes of deaths were rejected multiple times, only to be <a href=\"https:\/\/www.news247.gr\/magazine\/reportage\/ipothesi-routsi-pos-to-anexigito-oxi-se-ena-dikaio-aitima-egine-nai\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">authorised<\/span><\/a> after a victim\u2019s father\u2019s hunger strike but with limited impact on the main case file.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\">The <i>de facto <\/i>policy of violent <span class=\"s1\"><b>enforced disappearance of people seeking asylum<\/b> <b>(\u201cpush backs\u201d)<\/b><\/span> continues unabated despite last year\u2019s <a href=\"https:\/\/hudoc.echr.coe.int\/eng#%7B%2522itemid%2522:%5B%2522001-240242%2522%5D%7D\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">landmark condemnation<\/span><\/a> from the ECtHR, <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex:62024CJ0136\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">acknowledgment<\/span><\/a> of the practice by the Court of Justice of the European Union (CJEU), and an abundance of evidence and criticism from all major human rights monitoring bodies at <a href=\"https:\/\/nchr.gr\/images\/rec_mechanism\/Annual_Report_2024.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">domestic<\/span><\/a> and <a href=\"https:\/\/rm.coe.int\/memorandum-on-greece-on-migration-and-border-control-following-visit-t\/1680b5a661\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">international<\/span><\/a> level. To this day, no push back case has proceeded beyond the preliminary examination stage, nor has any disciplinary action been taken against Hellenic Police and Hellenic Coast Guard officers. Prosecutors continue to shelve investigations and to dismiss complaints for want of sufficient indications of wrongdoing. Among other investigative flaws, Prosecutors insist on a circular reasoning whereby push backs are not perpetrated by state officials because they are prohibited by law.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\">More generally, <span class=\"s1\"><b>police violence<\/b> <\/span>remains widespread, encouraged by a persistent \u201cculture of impunity\u201d and a failure to deliver justice to victims despite multiple ECtHR condemnations. In January 2026, the Public Prosecutor of Athens <a href=\"https:\/\/www.efsyn.gr\/ellada\/dikaiosyni\/497199_i-kratiki-dolofonia-kamran-sto-arheio\" target=\"_blank\" rel=\"noopener\"><span class=\"s2\">shelved<\/span><\/a> the investigation into the death of Mohammad Kamran inside the Agios Panteleimon police station in September 2024, after eight days of detention in multiple police stations across Athens. Despite photographic evidence of signs of extensive abuse and a forensic report showing beatings as a concurring cause of death, the Prosecutor found no indications of wrongdoing on the part of police officers. The case file contained near-identical testimonies from police officers and failed to identify or question the people detained together with the victim. No explanation was offered as to why the surveillance cameras of the police station were not working at the time of the incident.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a16147f elementor-widget elementor-widget-heading\" data-id=\"a16147f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Persistently poor law-making<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77fdd5b elementor-widget elementor-widget-text-editor\" data-id=\"77fdd5b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Rules on the preparation, submission and adoption of legislation continue to be systematically disregarded. The Greek legislative process remains largely underpinned by <i>polynomia<\/i> manifested in overregulation through multiple laws, and <i>kakonomia<\/i> due to poor drafting practices and contempt for good law-making principles.<\/p><ul class=\"ul1\"><li class=\"li1\">More than 250 articles were voted by Parliament without undergoing prior <span class=\"s1\"><b>public consultation<\/b><\/span>. Feedback from public consultations and experts\u2019 views are often not adequately considered.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\"><span class=\"s1\"><b>\u2018Omnibus\u2019 legislation<\/b> <\/span>remains a prevalent practice. 80% of bills passed last year bore a title that included the terms \u201cand other provisions\u201d and often included extensive regulation of multiple unconnected topics.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\">The same goes for <span class=\"s1\"><b>late and irrelevant amendments<\/b><\/span>. 51 of the 53 ministerial amendments tabled last year were unrelated to the subject matter of the bill. 44 of the 53 amendments were filed either on the day or the eve of adoption of the law.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\"><span class=\"s1\"><b>Recurrent modification of laws<\/b> <\/span>persists, even for legislation adopted only months earlier. At least 15 laws \u2013 even codes \u2013 enacted in 2025 underwent amendments that same year. This poses critical risks for legal certainty and accessibility, since consolidated versions of legislation are still not accessible to the public free of charge.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d9dadf elementor-widget elementor-widget-heading\" data-id=\"2d9dadf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">At the bottom of press freedom<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b0f0ab elementor-widget elementor-widget-text-editor\" data-id=\"3b0f0ab\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Reporters Without Borders (RSF) <a href=\"https:\/\/rsf.org\/en\/index\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">ranked<\/span><\/a> Greece last in the EU on press freedom for the fourth year in a row. Journalists and media outlets continue to face attacks, threats and intimidation for performing their work. This includes a notable presence of SLAPPs in areas ranging from the <a href=\"https:\/\/thepressproject.gr\/aporrifthike-i-agogi-dimitriadi-kata-kouloglou\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">\u201cGreek Watergate\u201d surveillance scandal<\/span><\/a> to <a href=\"https:\/\/gr.boell.org\/en\/2025\/12\/08\/eco-slapps-legal-intimidation-weapon-silence-environmental-and-public-space-defenders\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">environmental cases<\/span><\/a>. Greece has not transposed the Anti-SLAPP Directive to date.<\/p><p class=\"p1\">Public media, supervised by the Secretariat-General of Communication and Information under the authority of the Prime Minister, remain vulnerable to political interference. Non-compliance with objectivity principles has been reported in the Hellenic Broadcasting Corporation (ERT) coverage of public interest matters such as the Tempi train crash <a href=\"http:\/\/govwatch.gr\/en\/finds\/mi-antikeimeniki-kalypsi-ton-diadiloseon-gia-ta-tempi-apo-tin-ert-26-1-2025\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">demonstrations<\/span><\/a>.<\/p><p class=\"p1\">Concentration of private media in the hands of wealthy families and shipping magnates with close political affiliations has affected the media environment. Rules that would have entrusted the National Council for Radio and Television (NCRTV) with the duty to assess media market concentration were ultimately dropped from domestic legislation implementing the European Media Freedom Act. Gifts to MPs are not available on a public register, whereas gifts to Ministers and Deputy Ministers were again made public only after an <a href=\"https:\/\/vouliwatch.gr\/actions\/article\/dora-kyvernisis-2024\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">unanswered request<\/span><\/a> for access to information.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\"><span class=\"s2\"><b>Asset declarations<\/b> <\/span>are not promptly accessible on account of constant deadline extensions introduced through irrelevant amendments, and <a href=\"https:\/\/vouliwatch.gr\/actions\/article\/dora-kyvernisis-2024\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">delays<\/span><\/a> in publication.<\/li><\/ul><ul class=\"ul1\"><li class=\"li1\">The <span class=\"s2\"><b>Committee for the Investigation of Declarations of Assets (CIDA)<\/b><\/span> has shown inconsistencies in fulfilling its statutory obligations, while <a href=\"https:\/\/vouliwatch.gr\/actions\/article\/isologismoi-2024-anafora\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">requests<\/span><\/a> for access to information rarely elicit a response.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8bf0d2d elementor-widget elementor-widget-heading\" data-id=\"8bf0d2d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Civil society attacked and criminalised<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad2ea0a elementor-widget elementor-widget-text-editor\" data-id=\"ad2ea0a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">The government has taken no steps to alleviate longstanding concerns voiced by <a href=\"https:\/\/commission.europa.eu\/document\/download\/f2eb4e57-317a-4be4-8baa-b667c9f801d9_en?filename=12_1_63944_coun_chap_greece_en.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">EU<\/span><\/a>, <a href=\"https:\/\/rm.coe.int\/memorandum-on-greece-on-migration-and-border-control-following-visit-t\/1680b5a661\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Council of Europe<\/span><\/a> and <a href=\"https:\/\/spcommreports.ohchr.org\/TMResultsBase\/DownLoadPublicCommunicationFile?gId=30349\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">UN<\/span><\/a> bodies against the hostile environment, intimidation and disproportionate registration requirements faced by civil society organisations, especially those working with refugees and migrants. On the contrary, the Migration Ministry has <a href=\"https:\/\/www.coe.int\/en\/web\/ingo\/-\/cingo-president-and-expert-council-react-to-recent-statements-by-greece-s-minister-of-migration-and-asylum\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">publicly attacked<\/span><\/a> organisations for representing individuals before the ECtHR and has spearheaded a reform rendering the mere membership of a registered NGO an <a href=\"https:\/\/rsaegean.org\/en\/greece-ngo-work-a-punishable-offence\/\"><span class=\"s1\">aggravating circumstance<\/span><\/a> for immigration offences that leads to 10-year imprisonment terms and tens of thousands of euros in fines. Facilitation of \u201cillegal stay\u201d by an NGO worker is punished more severely than torture.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-05ee1f2 elementor-widget elementor-widget-heading\" data-id=\"05ee1f2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Data protection flouted<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-599a96c elementor-widget elementor-widget-text-editor\" data-id=\"599a96c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Important decisions from the Hellenic Data Protection Authority (DPA) highlight yet again the limited consideration paid to the protection of personal data, from the roll-out of <a href=\"https:\/\/homodigitalis.gr\/en\/posts\/135717\/\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">police facial recognition systems<\/span><\/a> to <a href=\"https:\/\/www.dpa.gr\/sites\/default\/files\/2024-12\/19_2024_3388%2520anonym.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">data retention policy<\/span><\/a> implemented by telecommunications providers. Meanwhile, the prior DPA decision on surveillance systems in refugee camps remains <a href=\"https:\/\/homodigitalis.gr\/wp-content\/uploads\/2025\/07\/Data-Rights-Violations-in-the-Samos-CCAC_pdf.pdf\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">unimplemented<\/span><\/a> and is pending judicial review before the Council of State.<\/p><p>\u00a0<\/p><p class=\"p3\" style=\"text-align: center;\">***<\/p><p class=\"p1\">Our organisations have submitted this report to the European Commission and have continuously and closely engaged with its <a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/policies\/justice-and-fundamental-rights\/upholding-rule-law\/rule-law\/what-does-commission-do-uphold-rule-law_en\" target=\"_blank\" rel=\"noopener\"><span class=\"s1\">Rule of Law Report process<\/span><\/a> with thorough documentation of pervasive, interconnected issues and deficiencies within Greek institutions as we experience them in our daily work and reality.<\/p><p class=\"p1\">Yet, the state of Greek institutions depicted by the European Commission varies dramatically from the findings we convey each year.
