{"id":19044,"date":"2024-04-01T13:44:00","date_gmt":"2024-04-01T10:44:00","guid":{"rendered":"https:\/\/rsaegean.org\/?p=19044"},"modified":"2025-07-02T15:46:08","modified_gmt":"2025-07-02T12:46:08","slug":"rule-of-law-2024-greece-update","status":"publish","type":"post","link":"https:\/\/rsaegean.org\/en\/rule-of-law-2024-greece-update\/","title":{"rendered":"Greece in Institutional Decline: 60-day update"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"19044\" class=\"elementor elementor-19044 elementor-19026\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8526cf0 e-con-full e-flex e-con e-parent\" data-id=\"8526cf0\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f48272f elementor-widget__width-initial elementor-widget-mobile__width-initial elementor-widget elementor-widget-heading\" data-id=\"f48272f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h1 class=\"elementor-heading-title elementor-size-default\">Greece in Institutional Decline: 60-day update<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-07e7914 e-flex e-con-boxed e-con e-parent\" data-id=\"07e7914\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6b54575 elementor-widget__width-initial elementor-widget-mobile__width-initial elementor-widget elementor-widget-heading\" data-id=\"6b54575\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Addendum to the Joint Civil Society Submission to the European Commission on the 2024 Rule of Law Report\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bf50df4 elementor-widget elementor-widget-text-editor\" data-id=\"bf50df4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Civil society organisations have reiterated to the European Committee their <\/span><b>serious concerns about the backsliding of the country&#8217;s institutions<\/b><span style=\"font-weight: 400;\">, in the context of its annual supervision of the Rule of Law operation in the countries of the European Union.<\/span><\/p><p><span style=\"font-weight: 400;\">On January 2023, independent organisations<\/span><i><span style=\"font-weight: 400;\"> Vouliwatch, Greek Council for Refugees (GCR), Refugee Support Aegean (RSA), HIAS Greece, Hellenic League for Human Rights (HLHR) <\/span><\/i><span style=\"font-weight: 400;\">and <\/span><i><span style=\"font-weight: 400;\">Reporters United<\/span><\/i><span style=\"font-weight: 400;\"> submitted our <\/span><a href=\"https:\/\/rsaegean.org\/en\/rule-of-law-2024-report-greece\/\"><span style=\"font-weight: 400;\">report<\/span><\/a><span style=\"font-weight: 400;\"> to the European Commission\u2019s annual monitoring of Member States\u2019 systems through its <\/span><a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/policies\/justice-and-fundamental-rights\/upholding-rule-law\/rule-law\/rule-law-mechanism\/2024-rule-law-report_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Rule of Law Report<\/span><\/a><span style=\"font-weight: 400;\">. In our submission, we documented persisting deficiencies and emerging threats to the rule of law in Greece.<\/span><\/p><p><span style=\"font-weight: 400;\">With an <\/span><b><a href=\"https:\/\/rsaegean.org\/wp-content\/uploads\/2024\/03\/RoL2024_JointSubmission_CSO_Greece_Update.pdf\">addendum<\/a><\/b><span style=\"font-weight: 400;\"> that we submitted to the European Commission as part of its consultations with institutions and entities in Greece<\/span><b> in mid-March<\/b><span style=\"font-weight: 400;\">, we highlight new and ongoing violations of the Rule of Law principles in our country, such as:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ce1a95f elementor-widget elementor-widget-text-editor\" data-id=\"ce1a95f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The head-on conflict of the Greek authorities with the EU institutions and their direct challenge, through public interventions by the Administrative Plenary of the Supreme Court and senior government officials <\/span><b>against the European Parliament Resolution of February 7, 2024<\/b><span style=\"font-weight: 400;\"> on the Rule of Law in the country, a conflict that is reiterated with recent questioning of the functioning of the European Public Prosecutor&#8217;s Office.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>ineffectiveness of judicial investigations<\/b><span style=\"font-weight: 400;\">, as reflected by new convictions of the country by the European Court of Human Rights (ECtHR) for flawed criminal investigations of incidents of <\/span><b>arbitrariness by the security forces<\/b><span style=\"font-weight: 400;\">, but also delays and interference in the <\/span><b>investigation of the surveillance scandal <\/b><span style=\"font-weight: 400;\">and the <\/span><b>Tempi accident<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>new reform of the Criminal Code<\/b><span style=\"font-weight: 400;\"> and the Criminal Procedure Code, as another example of <\/span><b>bad legislation and significant violations<\/b><span style=\"font-weight: 400;\"> of constitutional provisions, fundamental rights and principles of criminal law.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d7275a2 elementor-widget elementor-widget-text-editor\" data-id=\"d7275a2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\" style=\"text-align: center;\"><b>Based on the above, we reiterate our call to the European Commission to formulate concrete and strict recommendations to Greece<\/b><span style=\"font-weight: 400;\">, in order to ensure effective compliance of the country with Rule of
