{"id":18831,"date":"2024-03-01T10:40:05","date_gmt":"2024-03-01T08:40:05","guid":{"rendered":"https:\/\/rsaegean.org\/?p=18831"},"modified":"2024-06-10T15:32:54","modified_gmt":"2024-06-10T12:32:54","slug":"european-ombudsman-pylos-shipwreck","status":"publish","type":"post","link":"https:\/\/rsaegean.org\/en\/european-ombudsman-pylos-shipwreck\/","title":{"rendered":"The European Ombudsman on the Pylos shipwreck"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"18831\" class=\"elementor elementor-18831 elementor-18816\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5f599f4 e-con-full e-flex e-con e-parent\" data-id=\"5f599f4\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-a00dbb1 elementor-widget-mobile__width-initial elementor-widget elementor-widget-heading\" data-id=\"a00dbb1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h1 class=\"elementor-heading-title elementor-size-default\">The European Ombudsman on the Pylos shipwreck<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7651eca e-flex e-con-boxed e-con e-parent\" data-id=\"7651eca\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7cff3f7 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"7cff3f7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>\u201cNearly eight months after the Adriana incident, no changes have been made to prevent such an incident from reoccurring\u201d<\/em><br \/>Emily O\u2019Reilly, the European Ombudsman<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d511c1a elementor-widget elementor-widget-text-editor\" data-id=\"d511c1a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>On 28 February 2024, the European Ombudsman released her <\/b><a href=\"https:\/\/www.ombudsman.europa.eu\/en\/doc\/correspondence\/en\/182671\" target=\"_blank\" rel=\"noopener\"><b>conclusions<\/b><\/a><b> on EU search and rescue as related to the Pylos shipwreck. <\/b><span style=\"font-weight: 400;\">The European Ombudsman inquired into how the European Border and Coast Guard Agency (Frontex) complies with its fundamental rights obligations in the context of its maritime surveillance activities, in particular the Adriana shipwreck.<\/span><\/p><p><span style=\"font-weight: 400;\">This report comes after the <\/span><a href=\"https:\/\/rsaegean.org\/en\/frontex-report-pylos-shipwreck\/\"><span style=\"font-weight: 400;\">damning report<\/span><\/a><span style=\"font-weight: 400;\"> of the Frontex Fundamental Rights Office on the responsibility of the Greek authorities in the Pylos shipwreck, made public on 31 January 2024.<\/span><\/p><p><span style=\"font-weight: 400;\">In her report, the European Ombudsman underlines that there are <\/span><b>growing concerns about persistent violations of fundamental rights in Greece\u2019s border control operations<\/b><span style=\"font-weight: 400;\">. In the case of the Adriana shipwreck, the Ombudsman finds that Frontex had grounds to doubt whether Greece did comply with its fundamental rights obligations, since, for example, it explicitly ordered Frontex not to deploy surveillance aircraft to an ongoing emergency. She also cites the ECHR\u2019s recent condemnation of Greece for the <\/span><a href=\"https:\/\/rsaegean.org\/en\/podcast-the-farmakonisi-case\/\"><span style=\"font-weight: 400;\">Farmakonisi shipwreck in 2014<\/span><\/a><span style=\"font-weight: 400;\"> and, consequently, that <\/span><b>the Adriana tragedy took place when Frontex was fully aware of the recent history of concerns about the Greek authorities\u2019 compliance with fundamental rights obligations<\/b><span style=\"font-weight: 400;\">. She also cites that <\/span><i><span style=\"font-weight: 400;\">\u201crepeated allegations have been made by survivors, by media outlets and by civil society organisations that actions by the Greek Coast Guard (HCG) contributed to the sinking of the boat.\u201d<\/span><\/i><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The Ombudsman underlines that <\/span><b>the investigation of the shipwreck and any assessment of the facts is severely compromised by the <\/b><a href=\"https:\/\/rsaegean.org\/en\/pylos-timeline-archive\/\"><b>absence of video or other recording of the shipwreck<\/b><\/a><b> and the following events<\/b><span style=\"font-weight: 400;\">, which raises again a pattern of inadequate handling and subsequent investigation of such incidents from the Greek authorities.<\/span><\/p><p><span style=\"font-weight: 400;\">Furthermore, she concludes that \u201cit is regrettable that, at EU level, there is no single accountability mechanism that could independently investigate all related issues, including the role of the Greek authorities, the role of Frontex, and the role of any other relevant institution, such as the European Commission, which has responsibility for ensuring compliance with fundamental rights provisions under the EU Treaties.\u201d<\/span><\/p><p><span style=\"font-weight: 400;\">As for Frontex\u2019s role, the Ombudsman\u2019s inquiry also showed that Frontex has no internal guidelines on issuing emergency signals (e.g. Mayday calls), and that there is a failure to ensure Frontex\u2019s fundamental rights monitors are sufficiently involved in decision making on maritime emergencies, asking Frontex to address these and other shortcomings.<\/span><\/p><p><b>The European Ombudsman cites two overall conclusions requiring immediate and urgent attention.<\/b><span style=\"font-weight: 400;\"> First, given that <\/span><i><span style=\"font-weight: 400;\">\u201cFrontex is dependent on the actions of Member States to uphold its fundamental rights obligations and its duty to save lives [&#8230;] Frontex should consider whether the threshold has been reached to allow it to terminate, withdraw or suspend its activities with the Member State in question. It should publicly clarify its reasons for concluding that the threshold has or has not been reached.\u201d\u00a0<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Second, the Ombudsman calls upon the European Parliament, the Council of the EU and the European Commission to establish an independent commission of inquiry and take action, including recommendations on how to protect fundamental rights and the right to life in the response to maritime emergencies.<\/span><\/p><p><i><span style=\"font-weight: 400;\">\u201cWe must ask ourselves why a boat so obviously in need of help never received that help despite an EU agency, two member states\u2019 authorities, civil society, and private ships knowing of its existence.
